Claim for Payment of Technology Usage Fees
A developer of new transportation technology may claim payment of technology usage fees from a person who uses the new transportation technology (Article 102, Paragraph 3 of the Act; Article 99, Paragraph 10 of the Enforcement Decree)
Priority Application, Purchase, and Reflection in Design
- If a public institution recognizes that a new transportation technology is superior to existing transportation technology in terms of constructability and economic efficiency, etc., it must give priority application to the new transportation technology in facilities, etc. that the public institution develops, operates, or manages, or give priority to purchasing products that apply the new transportation technology (Article 102, Paragraph 4 of the Act)
- If a public institution recognizes that a new transportation technology is superior to existing transportation technology in terms of constructability and economic efficiency, etc., it must reflect the new transportation technology in the design of transportation facility construction projects carried out by the public institution (Article 99, Paragraph 5 of the Enforcement Decree)
- The Minister of Land, Infrastructure and Transport may notify public institutions of a list of new transportation technologies on a quarterly basis in order to promote priority application and purchase of new transportation technology, and a public institution that has been notified of the list of new transportation technologies must review whether to apply the technology, including reflecting it in design or conducting trial construction, and whether to give it priority in purchasing (Article 25 of the Regulations)
Priority Application to Pilot Projects, etc.
When implementing a pilot project, the Minister of Land, Infrastructure and Transport may give priority application to new transportation technology, and may provide financial and administrative support to developers of new transportation technology who participate in the pilot project (Article 99, Paragraph 3 of the Enforcement Decree)
Recommendation for Trial Construction
When a developer of new transportation technology or the head of a public institution requests trial construction within one year after being designated as a new transportation technology, the Minister of Land, Infrastructure and Transport may recommend trial construction to verify performance and construction methods, etc. (Article 99, Paragraph 7 of the Enforcement Decree)
Financial Support
In order to promote the dissemination, utilization, and commercialization of new transportation technology, the Minister of Land, Infrastructure and Transport may, upon request for financial support from a developer of new transportation technology, request relevant institutions to provide priority support from technology development funds, new technology business funds, technology credit guarantees, and other special funds raised by the government and public institutions for technology development and dissemination, etc. (Article 99, Paragraph 1 of the Enforcement Decree)
Support for Fees and Expenses
The Minister of Land, Infrastructure and Transport may, within the budget, support small and medium-sized enterprises for a portion of the costs incurred from performance and quality testing conducted during the review process, or a portion of the fees and expenses under Article 34 of the Regulations (Article 24, Paragraph 2 of the Regulations)
Award of Bidding Bonus Points
When a public institution or business operator implementing a transportation facility construction project places an order for transportation facility construction or design services, it may grant preferential treatment, such as awarding bidding bonus points, to new transportation technology in accordance with what is determined and publicly notified by the Minister of Land, Infrastructure and Transport (Article 99, Paragraph 4 of the Enforcement Decree)
Other Support
- Promotional support for new transportation technology, such as holding exhibitions, briefing sessions, and expos, supporting overseas expansion, and distributing promotional materials (Article 99, Paragraph 1, Item 3 of the Enforcement Decree; Article 24, Paragraph 1, Item 3 of the Regulations)
- Selection and commendation of outstanding new transportation technology (Article 24, Paragraph 1, Item 2 of the Regulations)
- When the head of each central government agency or a contracting officer determines that a contracting party's use of a new technology, construction method, etc. is recognized as having a significant effect in reducing construction costs, shortening the construction period, etc., and makes the necessary design change at the request of the contracting party, an amount equivalent to 30/100 of the resulting savings shall be deducted when adjusting the contract amount [Amended Dec. 31, 2008] (Article 65, Paragraph 4 of the Enforcement Decree of the Act on Contracts to Which the State is a Party)
